Well, that would be the Supreme Court, right? Not entirely. It's not just the SCOTUS who should deal with the issue of constitutionality. As one understands by reading the following . . .

Every sitting judge on the Fedral bench can decide. I form opinions all the time if something is unconstitutional. There are times I disagree with the Supreme Court. Too bad their opinions are law and mine are not. ;D

If there is any continuing question, it is ultimately settled by the Supreme Court.

Only if the Supreme Court agrees to hear the issue. That is not always the case.
