All they did was instruct the lower court to re-hear the case. They didn't throw anything out.
The lower court could just do the same thing. Hear it, then throw it out.

Well, the original post link gives you some background and it has been all over the news. The original Liberty University suit has been reinstated and sent back to that court. The parties are preparing briefs again.

They have the option of making the same decision as they did in the first place and Liberty has the option of appealing again if necessary.
