A HOA recently voted to ban children from playing outside. I read that a few days ago. I guess the leadership of that HOA forgot that they used to be children once.

After the fire ripped through Scripp's Ranch, the HOA tried to tell people how to configure the inside of their houses. They didn't want anything different from the old configuration. =Bob

They didn't want anything different from the old configuration. =Bob I would have told them to Fuk off in very impolite language. Being an uncultured German, I can be quite good at that. I've told the story before of my Great Grandfather on my father's mother's side, Fritz Passenheim who was home in the late evening in 1894 drinking his large stein of dark German beer and trying to relax after a hard days work as a carpenter when some idiot pounded on his door. When Fritz opened the front door the man wanted an apology from Fritz because Fritz's daughter (my Grandmother) beat up the man's son. (The boy had peed on Grandma's little sister from a branch of a tree that was over the sidewalk as the two girls walked home from school. Grandma threw rocks at the boy until he climbed down and then she beat the sheet out of him.) Fritz spend the night in jail after he threw the man in the city sewer (after Fritz removed the man hole cover) in the street. Fritz was a man of action and stormed back into the house and drank another full stein of beer before the police came and arrested him. A German judge the following morning released Fritz with no charges so he could go to work to support his family. The Judge, being German realized that there was sufficient aggravation to warrant throwing the man in the sewer. I've got Fritz's DNA. For a couple of years he made money as a bare fisted boxer in the bars of New York, Philli and Chicago after he immigrated to the United States. Heaven help any man who tried to give him a hard time.

And then there's this that someone sent me:
There are two recent cases of egregious HOA abuse from FL., both stemming from conflicts between seniors who control the board and younger families who just live there. One, in Edgewater, based on a rule that's been enacted but not yet finalized (there's apparently a challenge process.. and then, inevitably lawsuits), will bar kids from playing in public (on the streets, sidewalks or open spaces). They may do in their front or rear yards. In another case, Boca, a CC&R (not yet enacted and in the comment stage) will bar kids from essentially being seen from the street, restricting their presence to egress, indoors and enclosed yards. Of course, both of these CC&Rs would be subject to legal challenge, I would hope...

We both don't like HOAs, and think they are petty little tyrants sitting on a nickel's worth of power and using it to torment anyone subject to their authority. But going to the "macro" scene in this country, they are just a reflection of power hungry liberals trying to tell everyone else how to live their lives. The libtards want to tell us what kind of car to drive, force us into Soviet style high-rise domiciles close to public transportation hubs, spend billions of dollars we don't have on high speed rail schemes, tell us what kind of food to eat, confiscate brown bag lunches from our kids at school... and a myriad of other intrusions into every aspect of our existence. volokh.com/2011/04/12/banning-lunches-from-school/Where I live right now, there is an HOA. Thankfully, it is impotent. It was created in the 1920's, and part of the CCRs was that you could not sell your property to any persons of "color". It's still in there, but thankfully voided by law many years ago. Our dues are only 4 bucks a year, but the "board" keeps trying to get everyone to approve a hike in dues up to several hundred dollars so that they can do neighborhood maintenance that they think the city has neglected. I told them to go to hell, we might as well secede from the city rather than pay taxes plus the increased dues just to get the maintenance the city is responsible for doing. The president of the board is a lawyer, of course. And one has to wonder about kickbacks to contractors.

The conservatives try to tell us how to live as well but they're more interested in the bedroom. Either way, where do you live that there's been an HOA since the '20s? You can still find deeds from Kensington and a bunch of other communities with that same deed restriction and I think deeds in La Jolla had a restriction of selling to Jews until the '60s. The first Jewish profs at UCSD had to develop their own subdivision near campus in order to live in La Jolla. =Bob

What a bunch of morons. Just to explain this a bit from a land use POV. Condo projects are required, under State law, to have HOAs. For single family residential (SFR) neighborhoods, developers use the in order to build roads to private street standards which are narrower than public road standards. That often but not always applies to gated communities (parts of various communities such as Mira Mesa, RB and all of San Diego Country Estates in Ramona are not gated but have HOAs). Fortunately I had only one project while working for County Planning that involved an HOA. That was in Fallbrook and I was willing to approve it as long as it had a hiking/biking trail around the perimeter and a handbook telling what restrictions there would be prior to approval with a condition of approval being that every buyer got a copy of the handbook. HOAs are ugly because they allow petty tyrants to determine most every aspect of your life. One of the most egregious is not allowing clothes lines. Unless one doesn't have the time or far too many kids' cloths to wash, it's incredibly stupid to not have a cloths line. But apparently anything that would make a neighborhood look "poor" leads to some dumb ass notion that it will lower property values. =Bob

If you don't at least tolerate HOAs then it's simple....don't move into a community with one.
I live in one and depending on who is on the BOD is how the place is run. Some people who get on the BOD have their own agenda and their own biases. The only way to fairly run a committee or BOD is to treat everybody equally across the board.
I see the advantages and disadvantages of HOA.
Most people who complain the most are those who never do a damn thing i.e. volunteer to be on a committee or on the BOD. And, those who break the rules the most act just like little kids. They'll push and push knowing that they're breaking the rules and continue to push until they're told to knock it off. They'll wait awhile, and start it up again. It is truly amazing.

Bruce is correct. It's often hard to get owners to serve on a board. Therefore you do not get good people, perhaps just those who have some private reason for wanting to serve.
The other side of the issue is that perfectly reasonable HOA rules are frequently broken by tenants/owners who do act responsibly. Example: residents who give the gate combo to outsiders, which is a serious security risk.
It can be a mess either way.
