We will see if the PAC 12 will be paying the termination fee (aka Poaching) of $55 million on October 23rd. This will be another failed deadline by the mtn west. Plus their is an exit fee of $17 million per school which is 6x the tv revenue which doesnt have a timeline. The way i read it is the PAC 12 is stating that the mtn west is double deeping on the same fee. You can only penalize someone once but not twice for the same fee or action. Its like being charged twice for late fee on a credit card bill or being arrested twice for the same crime. In this case it done to deter the schools from leaving and creating a hostage situation. In SDSU case they have been penalized three times as last year they took revenue away for leaving the conference and coming back. It's essentially extortion since we were already scheduled to play both OSU and WSU this year. Like I said before, i'm waiting to see a school or conference to not pay this fees. The NCAA does not have any power on regulations. You see coaches get new contacts for millions of dollars and a week later they leave for another job without penalty.

We need a quick resolution or convince Memphis that $10M now is good and just add one program from the ACC. The Pac currently only has access to $65M to add programs. When they have to pay a poaching fee of $55M it gives only $10M to work with. UNLV wasn’t being offered any immediate assistance with their exit fee because the poaching fee would have gone up. The AAC schools were being offered a total of $10M.

I assume the purpose of the suit is to reach a settlement ? If not any idea of how long it will take to get resolution through the courts ?

If the Pac believes they are going to win, then there may be no need to settle unless they want certainty. The MWC might be more prone to settle, because they may be counting on that money to fulfill promises they made to the remaining MWC schools.

When the departing MWC members file suit against the MWC I will really want to read that complaint. The MWC office has complained that they had a "mole" during their meetings that are privy to their strategic plans. I am sure that SDSU was including in such meetings and if SDSU, and any other schools, were being treated differently than the rest of the conference I expect that will be used to lower the exit fee even more. The meetings between the PAC2 and the "First Four" were kept extremely secret. Nothing came out of that black hole until they were ready for it to. Much unlike the old PAC which leaked like a sieve - thanks U-Dub.

They will not be paying anything on October 23rd Now will the MWC be able to withhold distributions for the departing members come next July. At best, that money would be put in escrow. Thanks to Nevarez overspending to keep UNLV and AFA, the departing members will say that if she gets her hands on that money it will be spent and getting it back would then be extremely difficult. Almost wonder if Nevarez isn't working on behalf of the PAC sometimes because she is doing some really stupid $#!+.

Once the lawyers and accountants get together the MWC will have a "come to Jesus" meeting and settle for a bit more than they like would get if it goes to trial. Yes, the PAC will give them the "Charlie Sheen" treatment and "pay them to leave."

Any updates on the PAC/MWC suit? Was pushed back another month, with well into January before the PAC has to respond. Time is not on the side of the MWC. They will need some clarity regarding what they will get from the PAC and departing teams or their deal falls apart. This is why the MWC will negotiate the fees down. That is what I heard today but haven't seen confirmation.
