Just to make it clear when I referred to "republishing". A SDSU equipment manager came under fire for alleged transgressions. There was a ton of discussion on the AT forum of the time about it. One of our posters offered an "open letter" from a friend of his to Weber that had one sentence about the situation. Around the same time, a poster calling himself "AC" posted a rather nasty commentary about the equipment manager in an attempt to prove his point that it was nearly impossible to fire a State employee. I quoted his comment in order to refute his argument.
Both of us were sued on the basis of "republishing" libelous statements (the two people offering the original statements were never included in the litigation, probably because they were using "handles" while the other guy and I weren't).
The point, boys and girls, is if you ever see anything really inflammatory about someone in the public eye, do not quote it in your response. I had no idea there was such as thing as "republishing" until I got sued and it took me several months before my attorney got the posts through discovery that I found out exactly why I was getting sued.
And one other thing - I got handed a subpoena on a Saturday, July 3rd, telling me I had to be in court the following Friday. Wasn't enough time to find a good attorney, so I showed up in court and stated I was there 'in pro per" because I hadn't had enough time. Judge asked me if I intended to defend myself and I told him I wasn't an idiot, I just wasn't given the time to deal with the situation. And quite frankly, the judge was really pissed off that he had to grant another continuance.
Understand your rights and do not ever let the liars for hire that exist within the attorney ranks rattle you. These things take time but if they think they can intimidate you into some sort of settlement they will do it in a heartbeat.
And again, there are really great attorneys out there who will fight like crazy for you, so never assume that every attorney is just in it for the bucks.

I think the previous board (not sure if Tonotiuh or Zip) got a warning from the SD Union on spelling Brent S. name in a derogatory way.
I think someone just started a thread the other day with that same spelling.

I think the previous board (not sure if Tonotiuh or Zip) got a warning from the SD Union on spelling Brent S. name in a derogatory way. I think someone just started a thread the other day with that same spelling. It deserved to be spelled that way. And... there still is something called free speech in this country. I think. And there is still something call "litigation". Do not put William in that position. There are limits to free speech and as I pointed out, his initials are BS and he can't sue anyone for referring to him as that. =Bob

He's a public figure and the misspelling of his name is obvious satire.

No. According to Zip, he was contacted and warned (threatened) to stop posters from misspelling BS's name. I argued the exact same thing. He is a public figure and doesn't have a leg to stand on. I do find it ironic that a newspaper of all things is attempting to squash the freedom of speech. Heck, a radio station has been calling Meg Whitman "Nut-Meg" for quite some time.

And as a couple of us who have actually been sued have stated in the past, even if you win it does not necessarily mean that you get back all your attorney fees. And Zip had 10 grand in attorney fees that he did not recover when Bartel sued him. I had 3 grand. Another person had somewhere between those two. Try spending 4 hours in a workshop learning about all the new water quality rules that I went through yesterday that just got more and more depressing as it went on. If anyone on here is given the chance to invest in land development in North County, my advice is DON'T DO IT. =Bob
